Terms of Use

These terms are an agreement between you and Benjamin Chong (“we”, “us”) about your use of the Beela Focus app and the beelafocus.app website (together, “Beela Focus”). By creating an account or using Beela Focus, you agree to them. If you do not agree, please do not use Beela Focus.

Our Privacy Policy explains how we handle your information.

1. What Beela Focus is

Beela Focus is a focus timer wrapped in a game. You commit to a length of time, keep the app open and stay with your task, and you earn rewards that grow your Beela community.

Beela Focus is a productivity and entertainment product. It is not a medical product. It does not diagnose, treat or prevent any condition, including attention difficulties, and it is not a substitute for professional advice.

2. Who can use it

You must be at least 13 years old (16 in the European Economic Area and the United Kingdom) and able to enter into this agreement. If you are under the age of majority where you live, you need your parent’s or guardian’s permission, including for any purchase.

3. Your account

You need an account, created by signing in with an email link, Apple or Google. You are responsible for what happens under your account and for keeping your email and sign-in accounts secure. Tell us at support@beelafocus.app if you think someone else has access.

One account is for one person. Please give accurate sign-in information.

4. Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple devices you own or control, for your own non-commercial use, as allowed by these terms and by Apple’s App Store rules.

The app, its artwork, characters, text, sounds and code belong to us or to those who licensed them to us. These terms do not give you ownership of any of it.

5. How the game works

• Focus sessions. Rewards are earned by completing the time you committed to. Leaving the app or ending a session early can count as a failed session. A failed session earns no reward and can reduce your Momentum.
• Offline play. You can focus without a connection. Your phone records the session and sends it to our servers later.
• Our servers decide. Rewards, balances and purchases are confirmed on our servers. If what your phone shows differs from what our servers confirm, the server’s result applies and the app will correct itself and tell you what changed.
• Changes. We may change, rebalance, add or remove features, rewards, prices in Acorns, items and Beelas at any time.

6. Acorns, items and other virtual goods

Acorns are the game’s currency. You earn them by focusing, and you can buy them. Items, Beelas and other things in the game are virtual goods.

• Virtual goods are licensed to you, not sold. They have no cash value, are not your property, and cannot be exchanged for money, transferred, sold or given to anyone else, inside or outside the app.
• Buying something in the Store with Acorns is final.
• Some purchases in the Store also require recent focus time. Buying Acorns with money never requires it.
• Unused Acorns and virtual goods are lost when your account is deleted or closed.

7. Purchases with money

• Payment. Purchases of Acorns are made through Apple’s App Store and charged by Apple to your Apple account. Prices are shown before you buy and may include tax. Apple’s terms apply to the payment.
• Delivery. Acorns are added to your balance once Apple confirms the payment, usually within a few seconds. If a purchase has not arrived after a few minutes, contact us and include the email address on your account.
• No subscriptions. Beela Focus does not sell subscriptions. Each purchase is a one-time purchase.
• Refunds. Purchases are non-refundable except where the law requires otherwise. Apple, not us, handles refund requests for App Store purchases; you can ask Apple at reportaproblem.apple.com. Nothing in these terms limits any right to a refund that you have under the law where you live.
• If a purchase is refunded or reversed, we remove the Acorns from that purchase from your balance. If you have already spent some of them, we remove what remains; your balance does not go below zero, and items you already bought stay with you. We may limit or close accounts that misuse refunds.

8. Rules of use

You agree not to:

• cheat, or use automation, modified versions of the app, or manipulation of your device’s clock or of our systems to gain rewards you did not earn;
• access our systems in ways the app does not, probe or test their security without our written permission, or interfere with the service;
• copy, modify, reverse engineer or redistribute the app or its content, except where the law allows this despite these terms;
• use names or text that are unlawful, hateful, harassing, sexually explicit, or that infringe someone else’s rights;
• sell, trade or transfer your account, Acorns or virtual goods;
• use Beela Focus to break the law.

We may remove rewards gained by breaking these rules, change names that break them, and suspend or close accounts that do.

9. What you type

You keep any rights you have in the names and labels you type. You give us permission to store and display them to you as needed to run the app. Do not include personal or sensitive information about yourself or anyone else.

10. Feedback

If you send us ideas or suggestions, we may use them without any obligation to you.

11. Ending your use

You can stop using Beela Focus at any time and can delete your account in the app’s Settings. Deletion is immediate and permanent.

We may suspend or close your account if you seriously or repeatedly break these terms, if we must do so by law, or if we stop offering Beela Focus. If we stop offering it, we will give reasonable notice where we can. Sections 4 (ownership), 6, 12, 13, 14 and 15 continue to apply after your use ends.

12. No warranties

Beela Focus is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Beela Focus will always be available, free of errors, or that it will improve your focus or productivity. We do not promise that your progress will never be lost, though we work hard to keep it safe.

Some places do not allow these disclaimers, so some of them may not apply to you. Nothing in these terms removes rights you have as a consumer that cannot be waived by contract.

13. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Beela Focus. Our total liability for any claim relating to Beela Focus is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

These limits do not apply to liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud.

14. Apple

The app is distributed through Apple’s App Store, and Apple requires us to tell you the following. These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app, if any; to the fullest extent the law allows, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to meet a legal requirement, consumer-protection claims, or claims that it infringes someone’s intellectual property. You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with any third-party terms that apply when you use the app, such as your mobile data agreement.

15. Governing law and disputes

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Courts located in Alameda County, California have exclusive jurisdiction over disputes about these terms or Beela Focus, except that if you are a consumer, you keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.

16. Changes and general terms

We may update these terms. We will post the new version here and change the date at the top. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Beela Focus after that, you accept the new terms; if you do not agree, stop using it and delete your account.

If part of these terms is found to be unenforceable, the rest stays in effect. If we do not enforce a term, that is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours as part of a merger, sale or reorganisation. These terms, with the Privacy Policy, are the whole agreement between you and us about Beela Focus.
